These terms cover your use of amayarosewood.com and the basis on which Rose Global provides photography and video services.
A specific booking will normally also have its own written agreement. Where that agreement and these terms disagree, the booking agreement wins.
Using this website
You are welcome to browse the site and to share links to it.
Please do not attempt to interfere with the site, gain access to parts of it that are not public, or use automated tools to scrape its contents.
Copyright in the photographs
Every photograph and video on this site is the copyright of Rose Global unless credited otherwise. Copyright is retained by us and is never transferred by the act of being commissioned or paid.
The images here may not be copied, reproduced, republished, altered, used to train machine learning models, or used commercially without written permission.
Clients receive a licence to use the work they have commissioned. What that licence allows — which channels, for how long, and whether paid advertising is included — is set out in the agreement for that booking, and is summarised for hotel collaborations on the Hotels & Travel page.
Bookings
A booking is confirmed when it has been agreed in writing and any deposit has been paid. Until then, dates are not held.
Quoted fees cover the scope described in that quote. Additional shooting time, additional deliverables, or a broader usage licence are chargeable and will be agreed in writing before they are carried out.
Delivery
Delivery timescales quoted on this site are our normal working turnaround from the shoot date, and assume the brief has been agreed and any client sign-off happens promptly.
Editing style and image selection are exercised by us as the photographer. Clients are welcome to request changes, and reasonable requests will be accommodated.
Responsibility and limits
We take reasonable care in everything we do, and carry the equipment and backups appropriate to professional work.
Except where the law does not allow it to be limited, our liability in connection with a booking is limited to the fees paid for that booking. We are not liable for indirect or consequential losses, such as lost profits.
Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud.
Governing law
These terms are governed by the laws of the State of Arizona, United States, and the courts of that state have jurisdiction over any dispute.
